Tragic Accident Claims Life of Hugh MacLachlan Near Isle of Luing
Hugh MacLachlan, 58, lost his life in a harrowing fishing accident on 13 December 2023 when he became ensnared in a fishing rope and was dragged overboard, leading to drowning. The incident unfolded west of the Isle of Luing in Scotland, marking a fatal end to a routine fishing expedition aboard his vessel, Nista.
Deadly Rope Entanglement Described as a “Perfect Knot”
The Marine Accident Investigation Branch (MAIB) uncovered that Mr. MacLachlan’s ankle became trapped in the back rope of his fishing gear. This entanglement, described as a “perfect knot,” prevented escape and pulled him underwater. Despite his efforts, the relentless grip of the creel ropes—baskets used in fish trapping—sealed his fate.
After Mr. MacLachlan was dragged overboard, his unmanned boat continued drifting, eventually grounding on a shoal north of Belnahua three hours later. His body was later recovered, still entangled in the fishing gear that caused the tragedy.
MAIB Warns of Ongoing Risks in Creel Fishing Operations
The MAIB report emphasized that this incident underscores the ongoing, life-threatening dangers associated with creel and potting operations. These hazards remain a critical concern for fishermen working in Scotland’s coastal waters.
Mandatory Fatal Accident Inquiry to Investigate Circumstances
Given that Mr. MacLachlan was self-employed and working within the territorial jurisdiction of Argyll and Bute’s Oban Sheriff Court at the time of his death, a Fatal Accident Inquiry (FAI) is compulsory. The Crown Office and Procurator Fiscal Service (COPFS) has initiated court proceedings with a preliminary hearing scheduled for 29 May at Oban Sheriff Court.
The inquiry will rigorously examine the cause and circumstances of Mr. MacLachlan’s death. It will also explore what safety measures could have prevented the accident and what protocols might reduce the risk of similar tragedies in the future. Unlike criminal trials, the FAI focuses on fact-finding rather than assigning blame.
Official Statement from Procurator Fiscal
Procurator Fiscal Andy Shanks, responsible for death investigations at COPFS, stated: “The death of Hugh MacLachlan occurred during his employment, making a fatal accident inquiry mandatory. The initiation of these proceedings under the sheriff’s direction is a crucial step toward understanding this tragedy. We will ensure Mr. MacLachlan’s family remains fully informed as the case progresses.”
